Welcome to ReCoupe. These Terms of Use ("Terms") are a legal agreement between you and busybody life inc. ("we," "us," "our") governing your use of the ReCoupe mobile application ("the app"). By downloading or using the app, you agree to these Terms. This document also serves as the End User License Agreement (EULA) for the app.
ReCoupe is intended for adults — specifically new and expecting mothers — and you must be at least 18 years old (or the age of majority in your jurisdiction) to use it. By using the app, you confirm that you meet this requirement.
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app on Apple-branded devices that you own or control, solely for your own personal, non-commercial use, in accordance with these Terms and the App Store Terms of Service. You may not copy, modify, reverse-engineer, redistribute, or create derivative works from the app except as permitted by law.
ReCoupe provides general educational information about postpartum recovery. It is not medical advice, and it is not a medical device. The app does not diagnose, treat, cure, or prevent any condition. Content — including weekly guidance, check-ins, mood screening, symptom information, and red-flag warnings — is for general educational purposes only.
Always consult your own qualified healthcare provider with any questions about your health or your baby's health, and never disregard or delay seeking professional advice because of something you read in the app. If you are experiencing a medical emergency, call 911 (or your local emergency number) immediately. The Edinburgh Postnatal Depression Scale (EPDS) and other screening tools in the app are informational and are not a substitute for evaluation by a professional.
ReCoupe offers an auto-renewable subscription ("ReCoupe Premium") that unlocks additional features. Subscriptions are sold and processed by Apple through the App Store, and the following terms apply:
We do not receive or store your payment details. Refunds are handled by Apple in accordance with the App Store Terms of Service.
ReCoupe is built privacy-first and stores the information you enter only on your device. For details, see our Privacy Policy, which is incorporated into these Terms by reference.
You agree to use the app only for lawful purposes and not to misuse it, interfere with its operation, or attempt to access it in any unauthorized way.
The app and its content, design, and trademarks are owned by busybody life inc. or its licensors and are protected by law. These Terms do not grant you any rights to our trademarks or branding.
The app is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
To the maximum extent permitted by law, busybody life inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of (or inability to use) the app. Nothing in these Terms limits liability that cannot be limited under applicable law.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and post the new version at this address. Your continued use of the app after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles, except where local consumer-protection law requires otherwise.
Because the app is distributed through the Apple App Store, the following additional terms apply, and in the event of any conflict with the rest of these Terms, the following control with respect to your use on Apple devices:
These Terms are concluded between you and busybody life inc. only, and not with Apple. busybody life inc., not Apple, is solely responsible for the app and its content. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the app.
The license granted to you is limited to a non-transferable license to use the app on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the App Store Terms of Service.
busybody life inc. is solely responsible for providing any maintenance and support services, as specified in these Terms or as required under applicable law. Apple has no obligation to furnish any maintenance and support services with respect to the app.
busybody life inc. is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app.
busybody life inc., not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and/or use of the app, including but not limited to: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
In the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, busybody life inc., not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
